Final Approval Granted for Electrolux Settlement

On February 10, 2016, U.S. District Judge Noel Hilman of the District of New Jersey gave final settlement approval in the Electrolux Home Products class action litigation. The settlement has the potential to be worth up to $20 million. The class is made up of around 100,000 members who claim that the Electrolux ice makers they purchased failed to provide “ice at your fingertips” as it had been marketed to do and instead began leaking just months after purchase, causing damage to the refrigerator.

Named plaintiff, Mariusz Kuzian, claimed that a year after purchasing an Electrolux French Door Bottom Freezer Refrigerator, the ice maker stopped working and six months after having it repaired, the ice machine and the refrigerator’s front electronic display stopped working. Kuzian also claimed that the unit’s interior light did not shut off when the doors closed, causing the internal temperature of the refrigerator to rise and food to spoil. Class members claim that the problems with the refrigerators were caused by design defects, which the defendant either knew about or was reckless in not knowing about.

According to the terms of the settlement, class members are entitled to $100 cash in addition to a $100 rebate that can be used if they purchase any Electrolux product worth $499 or more. A $250,000 reimbursement fund has been established for class members who paid out-of-pocket for repairs. Named plaintiffs will also receive $32,500 worth of service payments. Judge Hilman approved an award of $2.75 million in attorneys’ fees to be split between counsel.
